Terms of Service

These terms cover your use of JobsiteHQ at jobsitehq.app. Using the app means you accept them.

What JobsiteHQ is

A tool for logging jobs: you record a walkthrough, it drafts a punch list you edit, and it keeps the photos, receipts, estimates and invoices for that job in one place. It installs from your browser to your home screen and works offline, syncing when you have signal.

Your account

You need an account, and you are responsible for what happens under it. Give accurate details and keep access to the email address on the account, since that is how you sign in. Tell us promptly if you think someone else has access.

Subscription and billing

Paid plans are billed through Stripe. Your plan renews automatically until you cancel, and cancelling stops future charges from the end of the period you have paid for. You can manage or cancel your subscription from the billing area in the app. Prices and plan details are whatever is shown in the app when you subscribe.

We don't refund payments for partial periods. If you cancel partway through a month or year, you keep JobsiteHQ until the end of the period you have paid for and aren't charged again. If you switch between monthly and annual billing, the unused part of your current plan is credited toward the new one.

A trial code gives a free trial of the length it says, once per account, on a first trial only. Your referral link (Settings, "Give a month, get a month") gives another contractor a longer free trial, and the page it opens shows your business name. When an account that started with your link first pays for JobsiteHQ, we add a credit worth one month of the monthly plan to your account, which comes off your next JobsiteHQ bills. Credits have no cash value and can't be transferred; your own link doesn't work on your own account. We can change or end the referral program at any time, and credits already added stay on your account.

A founding code puts your subscription on the founding annual price shown when you start. We won't raise that price for as long as that subscription stays active. If you cancel it, let it lapse, or change plan, the founding price ends, and coming back later is at the price in effect then.

Recording limits

Turning recordings into punch lists costs us money every time, so there are limits on how much recording time JobsiteHQ processes. A paid plan includes up to 2 hours of recordings a day and 20 hours in any 30 days. A free trial includes up to 1 hour a day and 5 hours for the whole trial (10 hours for a trial longer than 14 days); adding a card during a trial moves you to the paid plan's limits, and you still aren't charged until the trial ends. A trial from a founding code has the paid plan's limits from the start. Typed or pasted text sent for a punch list counts as about one minute of recording per 900 characters. A recording that goes over a limit is still processed; the next one waits until there's room again. Everything else in the app keeps working. We may change these limits, and will say so here.

Taking payments from your clients

If you connect payments, you are contracting with Stripe and are bound by Stripe's terms as well as these. Your clients' payments go to your own Stripe account. JobsiteHQ is not a party to the work you agree with your clients, does not hold your clients' money, and is not responsible for the quality, pricing or completion of that work, or for disputes, chargebacks or refunds arising from it. Those are between you, your client and Stripe.

Automatic drafts are drafts

JobsiteHQ uses automated transcription and text generation to turn a recording into a draft punch list, to read a vendor and total off a photographed receipt, and to list the work shown on a set of plans as a draft estimate or punch list items. These are starting points, not results. They can mishear, misread and omit things, and a list read off plans is not a takeoff: its quantities are only what the plans state. Nothing is added to a job until you have reviewed it, and you are responsible for checking anything you send to a client or rely on for pricing, scheduling or your records.

Your content

Your jobs, clients, photos, recordings and documents remain yours. You grant JobsiteHQ only the permission needed to run the service for you: to store your content, and to pass it to the processors named in the Privacy Policy so the features work. We do not use your content to advertise, and we do not sell it.

You are responsible for having the right to record and store what you put in, including photographs taken on a client's property and details about people you work for.

Acceptable use

Do not use JobsiteHQ to break the law, to store content you have no right to, to harass anyone, or to attack, overload or reverse-engineer the service. Do not resell access or share one account across separate businesses.

Not professional advice

JobsiteHQ produces documents such as invoices, job reports and a tax export. These are record-keeping conveniences, not legal, tax, accounting or licensing advice. Rules vary by state and trade. Check with an accountant or the relevant authority for your situation.

Availability

The service is provided as is. We aim to keep it running and your data intact, but we do not guarantee it will be uninterrupted or error-free, and features may change. Keep your own copies of anything you cannot afford to lose — Settings gives you a full download of your account at any time.

Limitation of liability

To the extent the law allows, JobsiteHQ is not liable for indirect, incidental or consequential damages, for lost profits, or for lost data. Where liability cannot be excluded, it is limited to the amount you paid for the service in the twelve months before the claim.

Ending the arrangement

You may stop using JobsiteHQ at any time; see the Privacy Policy for how to get your data out and have your account deleted. We may suspend or close an account that breaks these terms, or where required by law, and will tell you why where we can.

Changes to these terms

These terms may change. The date at the top changes with them, and account holders are notified by email of material changes. Continuing to use the app after that means you accept the new terms.

Governing law

These terms are governed by the laws of the State of Wisconsin.
